Description
In 2018 the Office for Civil Rights (OCR) at the U.S Department of Health and Human Services set an all-time record for Health Insurance Portability and Accountability Act (HIPAA) fines and monetary settlements. OCR settled 10 cases and won a summary judgment in another. Together these cases totaled $28.7 million from enforcement actions, surpassing the previous record of $23.5 million set in 2016. In addition, OCR set a new record for the single largest individual HIPAA settlement in history of $16 million with Anthem, Inc. Commenting on the record year, OCR Director Roger Severino stated, “Our record year underscores the need for covered entities to be proactive about data security if they want to avoid being on the wrong end of an enforcement action.”
